Terms of Use

These Terms of Use ("Terms") describe the rules that apply when you access or use the websites, emails, and other online services provided by Econocredit and its affiliates (collectively, "Company," "we," "us," or "our") (together, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not access or use the Services. These Terms incorporate the Privacy Policy, and the limiting provisions herein apply to any claims related to such policy.
These Terms contain binding arbitration, a class action waiver, indemnification obligations, and limitations on liability. Please read carefully.
1. Changes to these Terms.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the updated Terms on the Services. If we make a material change, we may also ask you to accept the updated Terms before continuing to use the Services or notify you by email or in-product notice. Immaterial changes take effect when they are posted. Your continued use of the Services after the updated Terms are posted means you accept the changes.
2. Your Econocredit Account.
2.1 General requirements.
Most Services require an Econocredit account. To create an account, you certify that:
- You are at least 18 years old.
- You are a U.S. resident and have a valid U.S. Social Security number.
- The information you provide is true, accurate, current, and complete, and you will keep it updated.
- You are registering only for yourself and not on behalf of any other person.
- You will create a unique password that you do not reuse on other unaffiliated services.
You may not sell, transfer, or assign your account. You are responsible for keeping your password confidential and for all activity that occurs under your account. You must notify us immediately at privacy@econocredit.com if you believe your account is no longer secure.
2.2 Specific registration consents.
By creating an Econocredit account, you authorize us to:
- Create and maintain a profile for you using the information you provide and other information we collect.
- Verify your identity, including by sharing device information with third-party identity-verification and fraud-prevention providers, and by asking knowledge-based authentication questions.
- Request and receive your consumer report, credit score, and other consumer information from one or more consumer reporting agencies and other third-party data sources, and to do so on a recurring basis for the purpose of providing credit monitoring and alerts.
These authorizations remain in effect until you close your account or revoke them by contacting us at privacy@econocredit.com. Some Services depend on these authorizations and may not be available if they are revoked.
3. Ownership of the Services and Content.
3.1 Our intellectual property.
The Services, including their layout, design, software, features, and all content provided through them, are protected by copyright, trademark, and other laws. All rights in and to the Services that are not expressly granted in these Terms are reserved by us and our licensors.
Subject to your compliance with these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only. You may view, print, and download content from the Services solely for that personal use, and you must keep all copyright and other proprietary notices intact.
You may not:
- Copy, modify, distribute, sell, lease, license, or otherwise exploit any part of the Services or any content, except as expressly allowed in these Terms or under applicable law.
- Remove or alter any copyright, trademark, or other proprietary notices.
- Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Services, except where this restriction is prohibited by law.
3.2 Technology and anti-scraping/AI-use.
The cookies, pixels, tags, scripts, databases, code, and other technology that power the Services (collectively, the "Technology") are confidential and proprietary to us or our providers. You agree that you will not, and will not allow anyone else to:
- Access or attempt to access the Technology except through the interfaces we provide and only as allowed by these Terms.
- Use any robot, spider, scraper, crawler, or other automated means to access, extract, or index the Services or their data, except with our prior written consent.
- Use any information, data, or content from the Services to train, develop, or improve any machine learning model, artificial intelligence system, or similar technology without our prior written permission.
- Attempt to bypass any security or access controls or interfere with the operation or hosting of the Services.
You do not obtain any ownership rights in the Technology, and no licenses are granted except as expressly described in these Terms.
4. Content, Recommendations, and Third-Party Links.
4.1 Our content.
All text, images, audio, video, graphics, and other materials we provide through the Services ("Company Content") are for general informational and educational purposes only. Company Content may include sponsored, affiliate, or promotional material. You are responsible for evaluating whether any Company Content is appropriate for your use. You should not rely on Company Content as legal, medical, financial, safety, or other professional advice, and you should consult appropriate professionals where needed.
4.2 Analyses, estimates, and recommendations.
We may use your credit report, credit score, and other information you provide or that we collect to analyze, sort, score, rank, and personalize the information, tools, offers, and recommendations we show you. Any such analyses, estimates, approval-likelihood indicators, comparisons, calculators, or recommendations are illustrative and informational only. They are based on assumptions and available data, are not commissioned or endorsed by any third party, and are not a guarantee of any outcome.
You are responsible for evaluating whether any product, offer, or recommendation is right for you. We do not provide financial, legal, tax, or credit advice, and you should consult an appropriate professional before making financial decisions.
4.3 Third-party offers and applications.
We do not guarantee that you will qualify for, be approved for, or receive any particular offer, product, or service shown through the Services. Approval, pricing, terms, and availability are determined by the third-party provider. We will not submit an application or otherwise take action on a third-party offer on your behalf without your consent.
4.4 Scores may differ from those used by lenders.
Credit scores shown through the Services are educational scores intended to give you a general view of your credit. The score model, version, or bureau data we use may differ from those used by lenders, insurers, employers, or other third parties to evaluate you. Tracking the score we show may still provide a useful overview of your credit over time, but it should not be relied on as the score any third party will use to make a decision about you.
4.5 Sponsored and affiliate content.
Some parts of the Services contain links to third-party websites or offers for products or services where we may receive compensation if you click, apply, or make a purchase ("Sponsored Content" or "Affiliate Links"). If you use those links, you leave our Services and go to a site we do not control. We are not responsible for the content, products, services, or practices of any third-party sites or offers, and your dealings with those third parties are solely between you and them.
4.6 Third-party services.
The Services may allow you to access or interact with third-party platforms, apps, tools, or services ("Third-Party Services"). We do not control and are not responsible for any Third-Party Services, and we do not endorse or warrant them. Your use of any Third-Party Services may be governed by separate terms and privacy policies between you and the third party. You should review those terms and policies before engaging with any Third-Party Service. If you provide your contact information or other data in connection with a Third-Party Service, you understand that the third party may contact you or use your information subject to its own policies.
4.7 Chatbots and AI-assisted features.
From time to time, we may offer chatbots, virtual assistants, or other AI-assisted features through the Services. These features may have limitations and can generate inaccurate, incomplete, or inappropriate outputs. You should not rely solely on their answers, and you should verify any information before acting on it. AI-assisted outputs are not legal, financial, tax, or other professional advice.
5. Acceptable Use and Compliance with Law.
5.1 Acceptable use.
You may use the Services only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Use the Services in any way that violates any law or regulation.
- Use the Services to obtain consumer reports, credit scores, or other consumer information under false pretenses or in violation of the Fair Credit Reporting Act or other applicable federal or state law.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or attempt to interfere with the proper working of the Services, including by introducing viruses, worms, or other harmful code, or by overloading, "flooding," "spamming," or "crashing" the Services.
- Use the Services to build or support a competing product or service.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or any computer systems or networks connected to the Services.
- Encourage or assist any other person to do any of the above.
Any unauthorized use of the Services automatically terminates the permissions granted to you under these Terms, without prejudice to any other rights or remedies we may have.
5.2 Territorial restrictions.
The Services are intended for use by U.S. residents only. We make no representation that the Services or any content are appropriate or available for use in any other location. You may not use the Services where doing so would be contrary to local law or where local law would require us to register or qualify in that jurisdiction. We may limit the availability of the Services to any person, geographic area, or jurisdiction at any time.
5.3 Credit data authorization.
By enrolling in credit monitoring or credit report services through Econocredit, you acknowledge that you have provided written authorization under the Fair Credit Reporting Act (FCRA) for Econocredit to obtain your credit information from one or more consumer reporting agencies. This authorization and its terms are presented to you during the enrollment process and are incorporated into these Terms by reference.
By signing up for and enrolling in Econocredit's credit services, you specifically authorize Econocredit and its data partners to access your credit report for the purpose of providing you with the credit monitoring services described in these Terms. You acknowledge that you are the consumer whose credit information will be accessed. You understand that this authorization is voluntary and can be revoked by closing your account or contacting us at privacy@econocredit.com.
5.4 Credit data sources and third-party providers.
Credit report data, credit scores, and related credit monitoring information available through Econocredit are sourced through a licensed third-party credit data provider. Your data may be shared with this provider solely for the purpose of delivering the credit services you have requested. Our credit data provider may have its own terms of service and privacy practices governing their processing of your data — we encourage you to review those materials. We do not independently verify, modify, or guarantee the accuracy of credit data received from our provider or from consumer reporting agencies.
6. Monitoring and Disclosure for Administrative and Legal Reasons.
We may monitor the Services electronically, and we may access, use, preserve, transfer, or disclose your information and account activity without notice when we reasonably believe doing so is necessary to:
- Comply with applicable law, regulation, legal process, or governmental request.
- Enforce these Terms or our Privacy Policy, including investigating potential violations.
- Detect, prevent, or otherwise address fraud, security, or technical issues.
- Protect the rights, property, safety, or security of Econocredit, our users, or the public.
7. Disclaimers.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, COMPANY CONTENT, AND ANY PRODUCTS OR FEATURES MADE AVAILABLE THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
Without limiting the foregoing, we and our owners, officers, employees, partners, suppliers, and licensors do not guarantee that:
- The Services will meet your requirements or expectations.
- The Services will be uninterrupted, secure, timely, or error-free.
- Any information or content obtained through the Services will be accurate, complete, or reliable.
To the maximum extent allowed by law, we expressly disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
7.1 Credit data accuracy.
Credit report data, credit scores, and credit monitoring alerts displayed through our Services are provided by third-party consumer reporting agencies and credit data partners. We display this data as received and do not modify its content. We make no representations or warranties regarding the accuracy, completeness, or timeliness of credit data provided by third parties. If you believe any information in your credit report is inaccurate, you should contact the relevant consumer reporting agency directly to initiate a dispute.
7.2 Credit monitoring and educational services disclaimer.
The credit monitoring, credit report, credit score, and related services available through Econocredit are provided for educational and informational purposes only. These services:
- Are not intended to, and do not, constitute legal, professional, or financial advice.
- Are not a substitute for professional financial, credit, or legal advice.
- May not be relied upon for lending, insurance, employment, or other consequential decisions.
- Do not guarantee any particular credit outcome, score change, or financial result.
Credit scores displayed through our Services may differ from scores used by lenders and other third parties. Simulated credit scores, where available, are estimates only and should not be interpreted as a guarantee or prediction of actual future scores.
Econocredit does not provide credit repair services as defined under federal or state law, and no representative of Econocredit is authorized to provide financial or legal advice or to make guarantees regarding credit outcomes.
7.3 No credit decisioning; no consumer reporting agency.
Econocredit does not make credit decisions, lending decisions, or underwriting decisions of any kind. Credit data displayed through our Services is for your personal educational and informational use only. Using Econocredit's service does not constitute a credit inquiry or application for credit. Econocredit is not a consumer reporting agency as defined by the Fair Credit Reporting Act. We provide consumers access to their own credit information for personal review — we do not furnish consumer reports to third parties for the purpose of credit, employment, insurance, or other decisions.
8. Limitation of Liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS, OR CONTENT PROVIDERS BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; OR
- ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL,
ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow the limitation of liability for certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
You agree that these limitations of liability are a fundamental basis of the bargain between you and us and apply even if any limited remedy fails its essential purpose.
9. Indemnification.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Econocredit and its affiliates, and each of their respective officers, directors, employees, agents, licensors, suppliers, and partners (the "Econocredit Parties"), from and against any and all claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees and costs, arising out of or relating to:
- Your use of, or inability to use, the Services or any Company Content.
- Your violation of these Terms or any applicable law or regulation.
- Your violation of any third-party right, including any intellectual property, privacy, or contract right.
- Any dispute between you and a third party, including any provider of Sponsored Content, Affiliate Links, or Third-Party Services.
You may not settle any such claim without our prior written consent. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.
10. Dispute Resolution, Arbitration, and Class Action Waiver.
10.1 Binding arbitration.
If a dispute, claim, or controversy relating in any way to your use of the Services or these Terms cannot be resolved informally, it will be resolved by binding arbitration rather than in court, except for the limited exceptions below.
- The arbitration will be conducted by JAMS under its Commercial Arbitration Rules by a single arbitrator.
- Unless you and we agree otherwise, any arbitration hearing will take place in Austin, TX.
- Each side will pay its own fees and costs, except that the arbitrator may award costs as allowed under the rules or applicable law.
- The arbitrator will have the authority to decide the scope and enforceability of this arbitration agreement and to award all remedies that would be available in court on an individual basis. Any judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
- This arbitration agreement applies to all disputes, claims, and requests for relief that arose or were asserted before the effective date of these Terms or any prior version of these Terms.
10.2 Waiver of jury trial.
YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL in any dispute, claim, or proceeding arising out of or relating to the Services or these Terms.
10.3 Class action waiver.
ALL ARBITRATIONS AND OTHER PROCEEDINGS MUST BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU AND WE AGREE THAT CLAIMS OF MORE THAN ONE USER MAY NOT BE COMBINED OR CONSOLIDATED.
If a court decides that applicable law prevents the enforcement of any of this class-action waiver as to a particular claim, then that claim (and only that claim) must be brought in court and not in arbitration.
10.4 Time limit to bring claims.
To the extent permitted by law, any claim or dispute arising out of or relating to the Services or these Terms must be filed within one (1) year after it first arises or it will be permanently barred.
11. Governing Law and Venue.
These Terms and any dispute or claim relating to them or the Services will be governed by the laws of the State of Texas, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Except where prohibited by applicable law or where arbitration is required, any non-arbitrable claim or proceeding arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Austin, Texas, and you consent to the personal jurisdiction of those courts.
12. Termination and Deactivation.
12.1 Term; how the Agreement ends.
These Terms remain in effect until your account is deactivated and you stop using the Services. You may deactivate your account at any time by contacting us at privacy@econocredit.com or by following the instructions available in your account or our Help materials.
12.2 Suspension or termination by us.
We may suspend, restrict, or terminate your access to the Services, or any portion of them, at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms, the Privacy Policy, or applicable law.
- Your use of the Services creates risk to us, other users, or third parties, including risk of fraud or security harm.
- It is necessary to comply with legal process or a request from a governmental authority.
- We are no longer offering all or part of the Services in your jurisdiction.
12.3 Effect of termination; surviving provisions.
Upon termination, your right to access and use the Services ends. Sections of these Terms that by their nature are intended to survive termination — including ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and miscellaneous provisions — will survive.
13. Copyright Complaints.
We respect the intellectual property rights of others. If you believe that material on the Services infringes your copyright, you may send a notice to our designated copyright agent that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing and information reasonably sufficient to permit us to locate it.
- Your contact information.
- A statement that you have a good-faith belief that the challenged use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

14. Notices and Electronic Communications.

We may send you notices electronically (for example, by email or by posting on the Services). You consent to receive communications from us in electronic form and agree that such communications satisfy any legal requirement that they be in writing.
15. Miscellaneous.
These Terms, together with the Privacy Policy and any other terms, notices, or disclosures presented to you during enrollment or use of a specific Service, constitute the entire and exclusive agreement between you and Econocredit regarding your use of the Services, and supersede any prior agreements or communications on the same subject matter.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. No waiver of any provision of these Terms will be effective unless made in writing and signed by an authorized representative of Econocredit.
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign or transfer these Terms, your account, and the relationship governed by these Terms — including to one of our service providers, vendors, successors, affiliates, or as part of a corporate transaction or change of service provider — without restriction and without prior notice to you. In connection with any such assignment or transfer, we may also redirect or migrate your account to a different website, domain, or service surface, and your continued use after such transfer constitutes your acceptance of the assignment.
